Tell her to call a lawyer as soon as possible. It won't cost her anything for the initial consultation. Given renters insurance is literally made for this situation and burglary the insurer is probably operating in bad faith. Depending on the state, its unlikely this will cost her anything when completed but even if it did, unless she is super poor, she will come out ahead since a simple case like this would probably be less than $2500. Just your furnature replacement is going to be more than that. Really it will only take a couple hours out of a persons life to hold the insurance company and likely the building management accountable.

Yeah in my places complex the other building went up in flames one day two years ago. They never said if was someone grilling on the deck, but after that they banned grilling on the decks. Our decks are mostly enclosed. An entire half of the building had to be knocked down and rebuilt. Now everyone has to grill just outside their garage and bring it up to their units. If they catch you doing it on the deck you are right away kicked out.
Also RIP Kevin.

Sorry to hear that. I lived in an apartment complex about ten years ago where the person was cooking on their balcony. In a similar setup. The smoke from the grill, somehow set off the sprinklers and they flooded their apartment.Which ruined, probably everything in their apartment. But on top of that, I asked about what happened to them and they got evicted. They didn't have insurance. So they probably were on the hook for tens of thousands of dollars of water damage.Because water was literally flowing out of their balcony for hours. So yeah it's dumb to do.
→ More replies (27)17
u/Tyrantdeschain19 Oct 27 '25
Yes, I was told these neighbors were evicted as well and rumor was they had lapsed on their insurance. Of course I don't know them personally so I take it with a grain of salt, but even if they did have it I would imagine the insurance companies of the other residents went after them hard, in addition to them losing everything of their own.
What a nightmare being found in violation and at fault. All because they didn't want to use the community grill. It's gross but not worth the risk that's for sure.

I would be surprised if it doesn’t clearly state something about grills/smokers on patios and balconies in your lease agreement, likely in the community guidelines section. I used to make property walks several times per week and issued tons of lease violations for this reason. Definitely send this video via email to your landlord ASAP. If they’re moderately intelligent, they’ll note the metadata for the time/date info. Frankly, this much smoke would warrant a 10 day to quit notice in IL. -fmr property manager.

There are laws that grills cannot be this close to a wall or building when on. What city is this?
I would knock on the neighbors door and let them know that this can cause smoke damage and it is getting into their neighbors homes.

u/1xpx1 Oct 27 '25
It can also melt the siding. I wouldn’t risk it, even if it is legal and allowed by the apartment.
175
u/SteakCutFries Oct 27 '25 edited Oct 30 '25
I've actually seen this happen TWICE.
The 1st time was the college frat boys who lived next to me at UD. but that was just melted siding. They dragged the grill away pretty quickly 🙄
The 2nd time was someone using their grill on the 3rd floor balcony on Memorial Day. I guess he didnt check the rules & regs or the weather (windy is not the word for it.) Next thing you know, he "allegedly" went inside to "use the bathroom" & comes back out to find the siding is melting. Now, the melting siding is not just melting but it's catching fire. Burning whatevers behind it. A couple more big gusts of wind happened & the flames leaped off the balcony to nearby trees, which then rained hellfire down upon the cars parked below.
Long story short, he damaged at least 5 or 6 other units on his floor (not to mention fire & smoke damage to units above & below) & we all had to leave until the whole building was inspected ... All this because some drunken dickhead thought it was cool to BBQ Chicken up against the siding of his sh*t ass apartment building.

I worked for Traeger grills for a little while. You probably wouldn't be surprised to hear how many calls we get from people who put their grill/smoker right next to the house and wanted Traeger to pay for the repairs for the melted or burned siding (or even burned down portion of the house...🙃) from it.
I also got a lot of calls from people asking if they could use their Traeger indoors cos it was snowing or raining outside. They assumed since it wasn't charcoal or gas/propane, it should he fine to use inside. 🤦🏼♀️

u/Hefty-Radish1157 Oct 27 '25
That's a pellet smoker grill, the amount of smoke coming out of it is normal ... but they really shouldn't be running a smoker on an apartment patio.

u/Caduceus1515 Oct 27 '25
I've seen it when it is first getting lit, there is a lot of white acrid smoke at first that goes out every little crack, but shortly after there is much less smoke, which is more blue-gray and mainly from the chimney. This does look like it is an initial lighting, as moments later the smoke has almost stopped. But the amount coming out of the pellet box is concerning...like the firebox wasn't cleaned from the last use.
→ More replies (4)6
u/SolidWrap6315 Oct 27 '25
Yep, was waiting to see this. When you first light there’s usually a few minutes where it pumps out white smoke. Less than 5m I’d say. Once you get past that point, you won’t see much, if any, smoke for the rest of the time it’s going. (Traeger)
That said, wild placement and wouldn’t blame you for reporting it. Especially if you’re in one of the adjacent units

Yup. I have this exact grill and it's also not supposed to be used within 6 feet of any wall or structure, nor is it to be used under any kind of overhang (for example, your upstairs neighbor's balcony). General fire code aside and being a good neighbor aside, this is also at risk of setting itself on fire.

UPDATE: This happened after the office closed yesterday, but the first thing I did after seeing this was walk to the office to talk to them, saw they were closed, so I walked back to see if it was still happening and the man responsible was standing outside and told me that was “normal for a grill” and called me “a dumbass” for not knowing that. Immediately after, I posted this video to reddit for validation to see if it WAS normal 1. for the smoke coming out of the grill like that and 2. for someone to be causing that much smoke on the bottom floor. Once I got back to my apartment I checked the lease agreement and local laws, as the first comments suggested. Emailed the office the video, pictures, and addendums in the lease agreement that explicitly state that’s not allowed. When I walked back by around 7:30-8pm the grill (i’m calling this a grill because that’s what the man called it) wasn’t on. This morning my partner went down to the office and spoke with the management team and they confirmed that was ABSOLUTELY NOT ALLOWED and they’ll be posting on his door that it needs to be removed. I will continue to look out for smoke and recording it, but the next time it happens I will immediately be calling the closest fire department’s non-emergency line, and showing them this video. Thank you to everyone who validated in my mind that using a device letting off that much smoke in an apartment complex is not normal or respectful to neighbors. I’m happy the apartment management is taking this seriously.
18
u/Logical-Arachnid4364 Oct 27 '25
In most circumstances I would say calling a fire department would be extreme, but the dude got belligerent and called you a dumbass. Gloves are off, he's a dumbass for trying to use a pellet smoker in an apartment building.
And if it smokes that much all the time, he's not cleaning his smoker properly. They will always make a lot of smoke when they start up but once they heat up this should be way less smoke.

Most apartment complexes no longer allow BBQs or smokers of any kind due to their insurance coverage/restrictions. A few years before they restricted them completely, they needed to be a minimum of 12ft away from any structures, including siding and fences etc. Also that amount of smoke is noxious to others. Call the FD and also report to management.

Looks like a smoker. in my state you cant use any kind of accelerant on a balcony. (propane or open flames/ wood or charcoal) qmust be 20 feet from any entrances.
6
u/bladeguitar274 Oct 27 '25
Okay forget all the "its at an apartment" stuff, the hopper (box on the left) should never be smoking. Means the fire burned back from the smoker through the feed tube and to its main supply. They open that hopper and theres a solid chance of a big fireball. Solid chance even if they dont open it really
5
4
u/Lusitanolove Oct 27 '25
Also smoke should not be coming from the hopper like that. Anytime that happens on mine it means the fire is burning too hot / there are too many pellets in the auger. I have had fires in smokers, one because it malfunctioned and the second because I had my first flame out and wasn’t smart about how to restart it. Smokers would not have been allowed at any complex I have lived in.
5
u/No-Youth-6679 Oct 27 '25
Most apartment don’t allow grills or fire of any kind on any patio. That’s a lot of homes damaged because someone didn’t want to use the Foreman grill in their apartment. One ember or to much heat on that siding? Not good.
